This is the website privacy statement of Dynamic Trader Limited, with a registered address of 61 Victoria Road, Suite 152 – Pegaxis House, Surbiton KT6 4JX, England (registered company number 06063210). 

Dynamic Trader is committed to protecting and respecting your privacy.

This privacy statement sets out the basis on which Dynamic Trader will process any personal data that we may collect about you if you visit our website, or during Dynamic Trader contact with you. We therefore ask you to read this privacy statement carefully.

  • The information that DYNAMIC TRADER collectS about you

We may collect and process the following information about you:

  1. Information that you give us: This is information about you that you give to us by:

    1. filling in forms on our website (or other forms that we ask you to complete);

    2. giving us a business card (or similar); or 

    3. corresponding with us by telephone, post, email or otherwise. 

You may be asked to provide certain personal data when you sign up for services including name, address, telephone number, email address, billing information (such as a credit card number), and the type of personal computer being used to access the Services. 

  1. Information that the Dynamic Trader website and other systems collect about you:

    1. If you visit our website it will automatically collect some personal data about you and your visit, including the internet protocol (IP) address used to connect your device to the internet and some other information such as your browser type and version and the pages on our site that you visit. Dynamic Trader will collect personal data to enable us to manage your account (such as for billing purposes).

    3. If you exchange emails, telephone conversations or other electronic communications with our employees or upload information to the website, our information technology systems will record details of those conversations or the information uploaded, including their content. 

  • The uses that DYNAMIC TRADER makeS of your PERSONAL DATA

We may use your personal data for the following purposes, and may from time to time, review information about you held in our systems – including the contents of and other information related to your email and other communications with us – for compliance and business-protection purposes as described:

    1. to operate, administer and improve our website and premises and other aspects of the way in which we conduct our operations, in Dynamic Trader’s legitimate interests; 

    2. when you send email inquiries to us, the return email address is used to answer the email inquiry we receive;

    3. in instances where Dynamic Trader and a third party collaborate in order to provide our services, we may provide the third party with certain personal data, such as the name, address, and username of persons who subscribed to the services for the purpose of offering you other products and services. In this instance, personal data will not be used by the third party for any other purpose. 

    4. to comply with our legal and regulatory obligations and bring and defend legal claims. This may include reviews for the purposes of disclosure of information relevant to litigation;

    5. to protect Dynamic Trader’s business from fraud, money-laundering, breach of confidence, cyber-attack, theft of proprietary materials and other financial or business crimes – in Dynamic Trader’s legitimate interests.

    1. To the extent permitted by applicable law, these reviews of your personal data will be conducted in a reasonable and proportionate way. They may ultimately involve disclosure of your personal data to governmental agencies and litigation counterparties as described below, in compliance with law. 

    2. Your emails and other communications may also occasionally be accessed by persons other than the member of staff with whom they are exchanged for ordinary business management purposes (for example, where necessary when a staff member is out of the office or has left Dynamic Trader).

    3. Dynamic Trader will only process your personal data as necessary so that we can pursue the purposes described above, and then only where we have concluded that our processing does not prejudice you or your privacy in a way that would override Dynamic Trader’s legitimate interest in pursuing those purposes. 

    4. In exceptional circumstances Dynamic Trader may also be required by law to disclose or otherwise process your personal data. We will tell you, when we ask you to provide information about yourself, if provision of the requested information is necessary for compliance with a legal obligation or, on the other hand, if it is purely voluntary and there will be no implications if you decline to provide the information. Otherwise you should assume that we need the information for our legitimate business or legal compliance purposes (as described above).

  • Disclosure and international transfer of your PERSONAL DATA

  1. We may disclose personal data about you either where we have obtained your consent or where it is reasonably necessary for the various purposes set out above:

    1. to the other users of the Dynamic Trader website as part of your and their trading activities related to the use of the website by Dynamic Trader members;

    2. to service providers who host our website or other information technology systems or otherwise hold or process your personal data on our behalf, under strict conditions of confidentiality and security;

    3. in exceptional circumstances:

  • to competent regulatory, prosecuting and other governmental agencies, or litigation counterparties, in any country or territory; or

    1. where we are required by law to disclose.

  1. The disclosures referred to in paragraph 3.1 above may involve transferring your personal information overseas. If you are dealing with us within the European Economic Area or the UK, you should be aware that this may include transfers to countries outside the European Economic Area / UK, which do not have similarly strict data privacy laws. In those cases, where we transfer personal data to other members of the Dynamic Trader group or our service providers, we will ensure that our arrangements with them are governed by data transfer agreements or mechanisms, designed to ensure that your personal information is protected (including, where appropriate, under an agreement on terms approved for this purpose by the European Commission). 

    1. Please contact us (see below) if you would like to know whether any such agreements referred to in paragraph 3.2 are in place or, if so, to see a copy.

  • Retention and deletion of your PERSONAL DATA

  1. We intend to keep your personal data accurate and up-to-date. We will delete the personal data that we hold about you in accordance with Dynamic Trader’s retention policies.

  1. You have a right of access to the personal data that we hold about you, under data protection law. You can also require any inaccurate personal data relating to you to be corrected or deleted.

    1. You can object to our use of your personal data for direct marketing purposes at any time and you may have the right to object to our processing of some or all of your personal data (and require them to be deleted) in some other circumstances.

    2. In some circumstances, you may also have a “data portability” right to require us to transfer your personal data to you or to a new service provider – however, please note that applicable law does not grant you an automatic right to data portability.
